Shop regulations:

  1. Definitions and general provisions

1.1. These Regulations contain framework provisions of the Sales Contract governing the conclusion and performance of Sales Contracts, payments, prices, release of Goods, complaints and protection of personal data in the Shop.

1.2. Within the meaning of the Regulations, the following capitalized terms mean:

1.2.1 Regulations – the present regulations of the online shop run at www.oriontecdladomu.pl.

1.2.2 Owner / Personal Data Controller / Seller - means Polish company Oriontec Spółka z ograniczoną odpowiedzialnością Spółka komandytowa, 43-391 Mazańcowice 57, NIP [taxpayer identification number] 9372676477, REGON [statistical number] 362608215, registered in the National Court Register under number
KRS 0000578111, running the Online Shop.

1.2.3 Online Shop - a website operated by the Owner, consisting of web pages, available at www.oriontecdladomu.pl, including other functionalities made available on the website www.oriontecdladomu.pl.

1.2.4 Customer - a natural person with full legal capacity, a legal person or an organizational unit without legal personality but having legal capacity, using the Online Shop, including in particular the one making purchases. 

1.2.5 Consumer - a Customer who is a natural person who purchases in the Online Shop not directly in connection with his business or professional activity (pursuant to article 221 of the act of 23 April 1964 Civil Code (Journal of Laws Dz.U.1964.16.93).

1.2.6 Customer Account - a created individual account containing Customer data provided by him in the Basket during execution of an Order; it allows the Customer to change such data, to track Orders placed by him.

1.2.7 Basket - functionality of the Online Shop, in which the products selected for purchase by the Customer are visible and enabling the Customer to determine and modify the Order data, in particular: the quantity of products, address for delivery, invoice data, method of delivery, payment method.

1.2.8 Product – the minimum and indivisible quantity of goods that can be ordered, and which is indicated in the Online Shop as a unit of measure in determining its price (price/unit). 

1.2.9 Order – an offer made via the Online Shop to purchase Products selected by the Customer and placed in the Basket.

1.2.10 Price – the amount of the remuneration payable to the Seller for the Ordered Products expressed in Polish zlotys. The price is a gross value, i.e. it includes all public levies.

1.2.11 Costs of Delivery - the cost related to the delivery of ordered Products depending on the method of delivery of Products selected by the Customer when placing the Order. Costs of delivery for particular methods of delivery are indicated in the gross value.

1.3. The http://www.oriontecdladomu.pl/ domain is owned by the Seller. All graphic elements and trademarks of Oriontec and those which the Seller is entitled to use and which are placed on the pages of the Online Shop are proprietary.

1.4. All information regarding Products published in the Online Shop, and in particular the data on the origin of goods, the manufacturer, should be complete, accurate and cannot be misleading to Customers.

1.5. The Seller does not charge any fees for communicating him with the use of means of distance communication, and the Customer will bear the costs of such communication in the amount arising from the contract concluded by him with a third party providing him with a specific service enabling the distance communication.

1.6. The Seller ensures to the Customer using the system the correct operation of the Online Shop in the following browsers: IE version 9 or newer, FireFox version 3 or newer, Opera version 9 or newer, Chrome version 10 or newer, on screens with horizontal resolution above 1024 pixels. The use of third party software affecting the functioning and functionality of browsers: Internet Explorer, FireFox, Opera, Chrome, may affect the correct display of the Online Shop, so in order to obtain full functionality, you must disable them all.

1.7. The Customer may use a remember me option for his data in the Online Shop in order to facilitate the process of placing the next Order. For this purpose, the Customer should register for himself an individual Customer Account by providing a login and a password necessary to access his account. The login and the password are a sequence of characters determined by the Customer, who is obliged to keep them secret and to protect against unauthorized access by third parties. The Customer can at any time access, correct and update data and delete the Customer Account in the Online Shop.

  1. Operation of the Online Shop

2.1 The Seller sells Products through the Online Shop.

2.2 The Products available in the Online Shop are in the Seller’s distribution network.

2.3 The Seller executes Orders and shipments of ordered Products exclusively on the Polish market.

  1. Ordering Products and execution of Orders

3.1 Orders are accepted through the Online Shop operated at the following address: www.oriontecdladomu.pl

3.2 Only the Products presented at the time of placing an Order through the Online Shop can be the object of sale.

3.3 The Seller reserves the right to withdraw individual Products from the Shop, however the withdrawal of a given product will not affect the execution of an Order already placed by the Customer.

3.4 The Seller reserves the right to introduce new Products in the Online Shop. 

3.5 The information placed next to individual Products in the Online Shop does not constitute an offer to conclude a contract within the meaning of the provisions of the Civil Code.

3.6 In order to place an Order, the Customer:

3.6.1 selects the Product or Products that he wishes to purchase by selecting the Add to Basket field.

3.6.2 in the Basket, the Customer fills in the data necessary to execute the Order, such as name and surname, method of delivery with address data or personal collection at the address provided by the Seller, email address, telephone number, payment method for the Products ordered and provides other relevant information for him in the “Comments” field. If the Customer wishes to make a purchase as part of his business, he must indicate the company name and address of the registered office or place of business, enter the NIP number [taxpayer identification number].

3.6.3 declares that he has read these Regulations and the Privacy Policy, and that he accepts their provisions. A sales contract is concluded when the following conditions are jointly met, i.e. when the confirmation is sent by the Seller via e-mail confirming the acceptance of the Order for execution and when the Price is paid for the purchased Products. 

3.7 The Seller reserves the right not to execute the accepted Order, in a situation where the Customer within 7 days of sending the confirmation of the Order for execution by the Seller does not make payment for the ordered Product or Products, except such Orders the payment for which will be collected on delivery. 

3.8 For the execution of an Order and issuance of an invoice, it is necessary that the Customer provides the necessary data indicated in the Basket on the Online Shop website. 

3.9 The Seller may contact the Customer at the e-mail address provided by the Customer or by phone, if the Customer provided his telephone number, in order to clarify doubts, confirm placement of an Order or in other matters related to the execution of the Order.

3.10 All orders are accepted and executed on working days from Monday to Friday. Orders are processed until 04:00 p.m.. All orders placed after this time will be processed on the next business day. Orders placed on public holidays and Saturdays will be processed in the order in which they were placed, on the first working day following the day on which the order was placed.

3.11 All Products are sent to the Customer within 48 hours from confirmation by the Seller of acceptance of the Order for execution and receipt of payment for the purchased Products, except Orders for which the on delivery payment method was selected, which Orders are executed within 48 hours from the moment of confirmation by the Seller of acceptance of the Order for execution. If the date of execution of the Order falls on Saturday or a public holiday, it will be executed on the next working day.

  1. Payments

4.1 The Customer can pay the Price for the Order by selecting one of the options in the Basket during the Ordering procedure:

4.1.1 Transfer to the Seller’s bank account operated by Alior Bank at the following number:

4.1.2 Payment on delivery.

4.1.3 PayU

4.2 Goods for which the Customer makes a prepayment will be sent only after the payment has been credited to the Seller’s bank account 

4.3 Each Order is accompanied by a receipt or an invoice if the latter was requested by the Customer in the “Remarks” to the Order.

  1. Delivery and waiting time

5.1 Orders for which the personal collection of Products has not been selected are delivered via courier. Costs of transport are covered by the Customer with the payment of the Price. Information on the amount of the Costs of Delivery will be visible to the Customer on the website of the Online Shop at the time of placing the Order.

5.2 The ordered Products will be sent to the address indicated by the Customer as the address for delivery.

5.3 The time of delivery includes: the time of Order execution (preparation of the Ordered Products for shipping) and the time of delivery by a courier.

5.4 If the time of waiting for the shipment is prolonged, the Customer will be notified of this fact by e-mail or by phone.

5.5 In order to collect the purchased Products, the Customer will present to the Seller or the courier (in the place of collection of goods) a printout of the Order acceptance confirmation or its reference number (also included in the e-mail containing the confirmation of acceptance of the Order by the Seller).
  

  1. Changes in the Order and returns

6.1 Any and all changes in the Order such as a change of the place of delivery of Products or increasing the number of Products included in the Order can be made by the Customer before the Order has been prepared for shipment. The Customer should immediately inform the Seller of the need to make changes in the Order via e-mail to the following address: sklep@oriontecdladomu.pl. The customer will receive a response via e-mail as to whether it is possible to change the order or not. 

6.2 The Seller provides for the possibility to return the purchased Products. The return of the Products may be accepted, provided that the Products are delivered intact, in original packaging. The return to the Seller is at the expense and risk of the Customer. Returns of purchased Products should be agreed in advance with the Seller via e-mail at the following e-mail address: sklep@oriontecdladomu.pl. Returns of purchased Products not previously agreed in the manner indicated in the preceding sentence will not be accepted. In the case of acceptance of the return by the Seller, within 7 working days, he will return to the Customer the Price paid by the latter in proportion to the value of the returned Products, to the bank account indicated by the Customer.

  1. Complaint form 

7.1 Pursuant to article 27 of the act on consumer rights of 30 May 2014 (hereinafter referred to as the Act) the Consumer the right to withdraw from a distance contract, without specifying a cause and without bearing any cost, except the costs specified in article 33, article 34 of the Act.

7.2 The time-limit to withdraw from a distance contract is 14 days from the date of delivery of goods, and it is enough to send a statement before the expiry of such time-limit.

7.3 The Consumer may submit the declaration of withdrawal from the contract using the form available in the tab: Returns and complaints / Complaint form.

7.4 The complaint form must be sent by post to the address of the company:
Oriontec Spółka z ograniczoną odpowiedzialnością Sp. K. Mazańcowice 57, 43-391 Mazańcowice accompanied by a document confirming the purchase (receipt or VAT invoice). 

7.5 The Seller will promptly confirm to the Consumer at his e-mail address (indicated in the Order or other if it has been indicated in the submitted statement) the receipt of the return.

7.6 In the case of withdrawal from the contract, the contract is deemed not concluded.

7.7 The Consumer is obliged to return the purchased Products to the Seller immediately, but no later than 14 days from the date on which he withdrew from the contract. The time-limit is considered observed if the Consumer returns the goods before its expiry.

7.8 The Consumer sends back the Products from the purchase of which he has withdrawn at his own expense and risk.

7.9 The Consumer is liable for the decrease in the value of the Products resulting from using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Products.

7.10 The Seller will promptly, no later than within 14 days from the date of receipt of the declaration of withdrawal (complaint form) submitted by the Consumer return to the Consumer all payments made by the latter, including the Costs of Delivery, and if the Consumer has chosen a method of delivery other than the cheapest standard delivery method offered by the Seller, the Seller will not reimburse the Consumer for additional costs in accordance with article 33 of the Act.

7.11 The Seller returns the payment using the same method of payment as this used by the Consumer, unless the Consumer has explicitly agreed to a different payment method, which does not involve any costs for him.

7.12 The Seller may withhold reimbursement of the payment received from the Consumer until the Products are returned or the Consumer provides the proof of their return, whichever is earlier.

7.13 According to article 38 of the Consumer Law the Consumer is not entitled to withdraw from the contract: 

7.13.1 in which the price or remuneration depends on fluctuations on the financial market over which the Seller has no control and which may occur before the time-limit for withdrawal from the contract expires; 

7.13.2 the subject-matter of which is provision of a non-prefabricated item, manufactured according to the Consumer’s specification or serving to satisfy his individual needs; 

7.13.3 the subject-matter of which is provision of an item which is liable to deteriorate or expire rapidly; 

7.13.4 the subject-matter of which is provision an item delivered in a sealed package, which after opening of the packaging cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery; 

7.13.5 the subject-matter of which is provision of items that after delivery, due to their nature, are inseparably connected with other items; 

7.13.6 for delivery of digital content that is not stored on a tangible medium, if the performance of the contract started with the Consumer’s explicit consent before the time-limit for withdrawal and after he has been informed by the entrepreneur of the loss of the right to withdraw from the contract; 

7.13.7 for delivery of newspapers, periodicals or magazines, except a subscription agreement.

  1. Prices

8.1 All prices presented in the Online Shop are in Polish zlotys (PLN).

8.2 The Prices presented by the Online Shop are expressed in gross values, i.e. they include all taxes and other public fees due in connection with the purchase of Products, and thus constitute the total amount payable by the Buyer to the Seller in connection with the purchase of Products.

8.3 The Seller reserves the right to change the prices of Products in the Online Shop. Change of prices does not apply to Orders accepted for execution by the Seller.

  1. Availability of the ordered Products

The Order is executed immediately when the Product is in stock. In the case of unavailability of all or part of the Products ordered by the Customer, the Customer will be informed about the status of the Order and will decide on its execution (partial execution, extension of waiting time, cancellation of the entire Order).

  1. Complaints regarding goods defective at the time of delivery

10.1 In the case of receipt of a Product which is not in conformity with the Order, the Customer has the right to lodge a complaint within 14 days of receiving the Product.

10.2 The method of handling and the time of considering the complaint regarding the Product purchased by the Customer depends on the type of the Product, its defects and its availability in stock. The maximum time for considering the complaint is 14 (fourteen) days from the moment the Seller receives the notification by e-mail to the following e-mail address: sklep@oriontecdladomu.pl

10.3 After receiving the parcel, the Customer should carefully check the package and the received Products. In the event of any mechanical damage to the Product during transport, a complaint report should be prepared in the presence of a courier and this fact should be indicated in it.

10.4 For the complaint to be handled by the Seller, the Customer should deliver to the Seller the Product or Products subject to the complaint together with proof of their purchase from the Seller and a description of the complaint.

10.5 Following consideration of the complaint in accordance with applicable law and taking into account the Customer’s request, the Seller will replace the defective product with a product free of defects or remove the defect. This does not affect the Customer’s right to make a statement on price reduction or withdrawal from the contract in accordance with applicable laws. If the defect constituting the basis for the complaint is not a minor defect, if the product cannot be replaced, the product defect cannot be removed or if the product has already been repaired or replaced, the Seller will refund the payment to the Customer in accordance with applicable laws.

10.6 The Customer purchasing a product for purposes directly related to his professional or business activity (Customer who is not a Consumer) has the right to lodge a complaint in accordance with applicable laws, while the Seller’s liability under the warranty for physical defects of Products is limited to the amount paid by the Customer to the Seller to purchase the Product concerned.

10.7 Under article 14 (1) OF THE REGULATION (EU) No. 524/2013 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR), we kindly inform you that the European Commission has made available, at the following address:

http://ec.europa.eu/consumers/odr, a platform for online dispute resolution system between Consumers and entrepreneurs at the EU level (ODR platform).

  1. Guarantee 

11.1 All products offered by the Online Shop are brand new products and are free from physical and legal defects.

11.2 The Seller is not liable for any defects, damage, contamination and non-compliance with the contract resulting from improper use, storage or maintenance of the Products. Improper use and cleaning is tantamount to termination of the guarantee before its expiration.

11.3 The Seller does not grant the Buyer a guarantee within the meaning of article 577 of the Civil Code, but informs about the guarantees known to him, granted by third parties, for the Products available in the Online Shop. In such case the text of the guarantee is attached to / is on the packaging of the Product and is issued to the Customer together with the purchased Products. There is a form available on the website which must be completed in order to report a defect of the goods under the guarantee. The form should be sent to the following e-mail address: 

sklep@oriontecdladomu.pl. Following receipt of the claim by the Shop, the Customer will receive a response to the message sent and further instructions on how to process the claim.

11.4 In the case of a complaint regarding the Products, depending on the Customer’s choice of the legal basis of the complaint, in matters not covered by these Regulations, the relevant provisions of the Civil Code will apply.

  1. Personal data processing

12.1 The Seller is the controller of personal data collected, processed and used in connection with the use of the Online Shop services by Customers to the extent and on the terms and conditions specified in the privacy policy of these Regulations (“Privacy Policy”)

12.2. The Customer may consent to sending commercial information by the Seller via means of electronic communication to the e-mail address indicated by the Customer in accordance with the act of 18 July 2002 on the provision of electronic services (Journal of Laws Dz.U.2017.1219 of 2017.06.24 ).

  1. Final provisions

13.1 These Regulations are available in the Seller’s registered office and in the Online Shop.

13.2 In matters not regulated by these Regulations, the provisions of the Polish law apply.

13.3 The Seller is entitled to unilaterally change the text of the Regulations in the case of:

13.3.1 amendment of the laws in force which apply to the provision of electronic services or distance contracts,

13.3.2 change of the offer of the Online Shop regarding services, provided that changes to the text of the Regulations are aimed at adjusting the text of the Regulations to the current offer.
