  1. Scope, purpose and basis of personal data processing

1.1. An administrator of the Oriontec dla domu online shop, available at (hereinafter referred to as the “Shop”) and a Controller of personal data is company Oriontec Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with a registered office in Mazańcowice 57, 43-391 Mazańcowice, entered into a register of entrepreneurs kept by the District Court in Bielsko-Biała, VIII Economic Division under number: 0000578111, NIP [taxpayer identification number] 9372676477, REGON [statistical number] 362608215(hereinafter referred to as “Oriontec”).

1.3. Oriontec complies with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as: the “GDPR”), properly protects personal data of Customers against unlawful access to personal data by third parties, in particular it encrypts personal data, archives personal data, assesses measures securing the personal data, ensures confidentiality, integrity, availability and resilience of processing systems and services.

1.4. Personal data provided by the Customers via electronic forms available in the Shop (i.e. in particular name, surname, address of residence, correspondence address, e-mail address, telephone number and, optionally, company name and tax identification number) are collected and used by Oriontec exclusively for the sale of the ordered products, to establish, investigate or defend against claims, for analytical, archival, accounting purposes, and to directly offer Oriontec products and services to users (direct marketing). The data will be processed for these purposes under article 6 (1) (b), (c) and (f) of the GDPR and, therefore, where: processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; processing is necessary for compliance with a legal obligation to which the controller is subject; processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

1.5. If consent is given to send commercial information by electronic means in accordance with the act of 18 July 2002 (Journal of Laws Dz.U.2017.12.19, i.e. of 2017.06.24), the Customer will receive, to his e-mail address, a Newsletter and other materials aimed at promoting Oriontec products and services (direct marketing). The consent to sending commercial information by electronic means may be revoked at any time.

1.6. Customers will not be subject to automated decisions (decisions without human intervention), and Customers’ data will not be subject to profiling.
1.7. This Website has not been designed for children below the age of sixteen, nor is it addressed to children.
1.8. Provision of personal data by the Customer is voluntary. However, failure to provide personal data by the Customer will make it impossible to conclude a sales contract and to use some of the services offered in the Shop. 

  1. Data Recipients

2.1. Subject to all guarantees ensuring the security of the data provided, the following recipients may have access to the Customer’s personal data:
a. employees / partners of Oriontec authorized to process them as per Oriontec’s instruction; 
b. service providers who provide Oriontec with technical and organizational solutions (in particular entities providing ICT services, marketing services, courier companies, legal and advisory services and their authorized employees);
c. entities who perform data analytics to personalize advertisements and are separate data controllers in this regard, in particular Google LLc.

2.2. Customer’s personal data may be transferred to countries outside the European Economic Area, such as: Google LLC (Privacy Policy) and The Rocket Science Group LLC d/b/a MailChimp (Privacy Policy) that are subject to certification within the EU - US PrivacyShield, what you can check at any time at: /

2.3. Apart from the cases indicated in paragraph 2.2, Oriontec will not transfer or allow the transfer of personal data provided by the Customer outside the EEA (i.e. outside the European Union, Norway, Liechtenstein, Iceland), unless it takes the necessary measures to ensure that the transfer is consistent with the GDPR. The measures in question may include, in particular, the transfer of personal data to a recipient in a country which, in accordance with the decision of the European Commission, provides adequate protection of personal data or a recipient in the United States who has certified the compliance with the EU-US Privacy Shield programme.

  1. Period of storage of data

The data will be processed for a period no longer than necessary for the use of the functionality of the online shop, and after that time they can be processed during the prescription period of any Oriontec’s claims or claims towards Oriontec. Personal data processed for the purposes covered by the declaration of consent will be processed for these purposes until the consent is withdrawn.

  1. Rights related to the processing of personal data

The Customer has the right to:
a. access his data and receive copies of such data;
b. rectify (correct) his data;
c. have his data deleted - if the Customer believes that there is no reason to process his data;
d. restrict the data processing - if the Customer believes that we have incorrect data about him or that we process them unjustifiably; or the customer does not want us to delete them, because he needs them to raise, pursue or defend claims; or for the time of the objection made by the Customer to the processing of data;
e. object to the processing of data for the purposes of direct marketing and the right to object to the processing of data on the basis of a legitimate interest for the purposes other than direct marketing;
f. data transfer - the customer has the right to receive from Oriontec, in a structured, commonly used machine-readable format, his personal data that he provided to Oriontec on the basis of a contract or consent. The Customer may also order Oriontec to send the data directly to another entity;
g. lodge a complaint with a supervisory authority - if the Customer believes that we process his data illegally, he may submit a complaint to the President of the Office for Personal Data Protection or another competent supervisory authority;
h. withdraw consent to the processing of personal data - at any time the Customer has the right to withdraw consent to the processing of personal data that Oriontec processes based on his consent; the withdrawal of consent will not affect the lawfulness of the processing, which was made on the basis of the consent before the withdrawal.

  1. Cookies policy and Google Analytics

5.1. Customer’s data can also be collected by cookies.

5.2. As a result of use of the Shop, the Customer’s devices may store text files (cookies), the purpose of which is to facilitate the Customer’s access to the Shop and its use, as well as to examine Customer’s preferences and behaviors to enable delivery of personalized content in the Shop and to improve the functioning of the Shop. The data are collected by cookies also for statistical purposes.

5.3. If the Customer has not disabled cookies, it is assumed that he agreed to place and store them in his devices. The Customer may disable the placement and storage of cookies from the level of his internet browser. The method to disable cookies depends on the browser used by the Customer. If cookies are disabled, the Shop may not work properly.

5.4. As part of running the Shop, Oriontec uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies. Data collected by Google Analytics with cookies (including the Customer’s IP address) are used to assess the use of the Shop by the Customer, create reports on website traffic for website operators and provide other services related to website traffic and Internet use . Google will not link the Customer’s IP address to any other data in its possession.

5.5. The Customer may prevent Google from collecting data from cookie files and processing them (including the IP address) by downloading and installing appropriate applications on his devices.

5.6. As part of running the Website, Oriontec uses Google AdWords, a service provided by Google, which helps us to better target our advertisements and promotions.

  1. Additional explanations on cookies

6.1. What are “cookies”?

The “cookies” files should be understood as IT data, in particular text files, stored in the terminal equipment of Customers, intended for the use of websites. These files allow recognizing Customer’s equipment and properly display the website adapted to his individual preferences. “Cookies” usually contain the name of the website from which they originate, their storage time on the terminal equipment and a unique number.

6.2. What “cookies” do we use?

As a rule, there are two types of “cookies” - “session” cookies and “persistent” cookies. The former are temporary files that remain in the Customer’s equipment until logging out of the website or turning off the software (web browser). “Persistent” files remain in the Customer’s equipment for the time specified in the “cookie” file parameters or until they are manually removed by the Customer. “Cookies” used by the website operator’s partners, including in particular the website’s Customers, are subject to their own privacy policy.

6.3. Do “cookies” contain personal data?

Personal data collected using “cookies” can be collected only for the performance of specific functions for the Customer. Such data are encrypted in such a way as to prevent access by unauthorized persons.

6.4. Deleting “cookies”

As a rule, the software used for browsing websites allows, by default, placing “cookies” in the terminal equipment. These settings can be changed in such a manner as to block the automatic handling of “cookies” in the settings of the web browser, or inform about each transfer of cookies to the Customer’s equipment. Detailed information about the possibilities and ways of handling “cookies” is available in the software (web browser) settings. Limiting the use of “cookies” may affect some of the functionalities available on the website.
